To determine what your entitlements may be it is first necessary to identify the principal award that you are bound by.

An award is a document made by the Queensland Industrial Relations Commission (the Commission), that lists all of the minimum wages and conditions that apply to classes of work or workers listed in the award.  

 

Construction workers and companies engaged on construction work in the private sector are generally bound by the Building Construction Industry Award - State 2003 (BCIA).  Construction work is defined as:

“all on-site work in connection with erection, additions, repair, renovation, maintenance, ornamentation, or demolition of building including the making, assembling, or fixing of woodwork and fittings in connection therewith, the making, preparing, assembling, and fixing of any material necessitating the use of tradeperson’s tools or machines on site.”

The majority of BLF members are engaged on construction work in the private sector and are bound by the BCIA, or a certified agreement underpinned by the award (that is whenever a certified agreement is silent on a matter then the award provisions apply).

A certified agreement is an agreement made between the union, the employer and the employees.  A certified agreement is certified by the commission.  

Building Trades Public Sector Award - State 2002 (BTPSA)

Construction workers employed by the Queensland State Government, Government Instrumentalities, and Local Authorities including the Brisbane City Council, are generally bound by the Building Trades Public Sector Award – State 2002.

The types of work covered by this award include:

“(a) the preparation, manufacturing or assembly of joinery and/or shopfitting components in a workshop, factory, or yard.

b) all aspects of masonry work performed in a cemetery, or, stonemasonry workshop, factory, or yard.

(c) the manufacture and working of all types of glass, including glass laminate, clear plastic, sheet acrylic or any substitute therefore in a workshop or factory. Such work shall include, but not be limited to, designing, bevelling, cutting, embossing or glazing by hand or machine, painting, silvering, sandblasting, bending etc. and every process incidental thereto, provided that this Award shall not apply where an employer is in the business of principally carrying out glass bevelling work.

(d) all facets of plumbing work performed in a workshop, factory or yard, or on-site.

(e) the manufacture of signs as well as signwriting work in a workshop, factory, or yard.

(f)   the demolition of buildings, the construction of new buildings, the construction of additions to existing buildings, and the necessary alterations of existing buildings, to make them conform to any new additions.

(g) the repair and renovation of buildings and structures necessitating the use of building tradespersons', or labourers' skills and/or tools.”

BLF members employed by Q-Health, Q-Build, TAFE, BCC, and GCCC are all bound by certified agreements underpinned by this award.
